Minutes of the meeting of Monday 02 December 2013 were presented and signed as a true and accurate record.



Declarations of Interest:




Community Land Trusts:

4.1 A presentation on Community Land Trusts (CLT’s) was received from Andy Lloyd, Community Land Trust Officer, Cumbria Rural Housing Trust.

4.2 An overview was outlined defining CLT’s as a not for private profit corporation that develops and stewards affordable housing and other community assets on behalf of the community. In terms of housing its priorities are local need & affordability, protection of homes and creating local re-investment income. Other areas covered within the presentation were:- advantages for communities, local authorities, housing associations and development funding arrangements. 

4.3 At the conclusion of the presentation Andy Lloyd was thanked for his attendance and contribution. He left the meeting at 7.59pm. 

4.4 It was resolved that Community Land Trusts should be an agenda item at the next Parish Council meeting.



Clerk’s Report:

5.1 The Clerk’s report was presented and accepted. Further information was given on:-

5.2 (Item 21) Communication had been received from the YDNPA asking if the Parish Council would like an Authority representative to attend a Parish Council meeting in 2014. It is appreciated that Authority representatives do attend and in some cases are members of Parish Councils, however, this provides the opportunity for members to meet a different Authority representative. It was agreed that an Authority representative should be invited to a Parish Council meeting in 2014.

5.3 (Item 22) It was reported that the precept request from the Parish Council in respect of the financial year 2014/15 had been sent to South Lakeland District Council prior to the deadline of 31 January 2014. Although the Government would not be making an announcement on ‘capping principles’ for Councils until 17 February guidance from the Cumbria Association of Local Councils suggested that it was unlikely that capping principles would apply to Parish Councils generally although some of the largest Councils may be affected.

5.4 (item 27) A letter had been received from the YDNPA inviting suggestions for new development sites in the National Park relating specifically to:-                               1) Business/employment use, and, 2) Elderly care accommodation. A suggested list provided by the YDNPA had already identified the former Lyon Equipment site in Dent. Further suggestions should be submitted to the YDNPA no later than 25 March 2014. A formal consultation will take place on specific sites later in the Spring. No further suggestions were offered by members.

Information received since the publication of the Clerk’s report included:

5.5 The owner of Cobble Cottage, Main Street, Dent, had reported that a hay wagon had recently collided with the property resulting in falling masonry which had been a significant risk to the public. He wished to raise awareness to the danger of large vehicles travelling through Main Street.  

5.6 As part of their Rural Crime Initiative to be launched later this year, Cumbria Police are promoting a Horse Watch scheme which will involve guidance for horse owners and ‘Horse Watch’ signage similar to the existing Neighbourhood Watch signs.

The Parish Council’s view had been requested on this matter. It was considered that the presence of signs may alert criminals to the presence of horses, create signage clutter and be of no benefit in highlighting one aspect of criminal activity over another as residents are encouraged to report suspicious activity to the Police in any case. 

It was resolved that Horse Watch signs should not be introduced to the Parish.

5.7 The Clerk reported that due to the continuous wet weather and the risk of flooding to properties he had made enquiries at the SLDC Amenities Centre at Canal Head, Kendal, with a view to seeking the District Council’s position on the provision of sandbags. It was established that any Parish resident may attend the Centre and collect up to 6 sandbags for the purpose of flood protection. Residents should report to Tony Jamieson at the Centre on weekdays between 7am and 3pm for collection purposes.

5.8   A guidance note had been received from the YDNPA relating to the Tour de France event later this year. The Authority is encouraging landowners to provide temporary campsites, caravan/motorhome sites and parking areas to cater for the large influx of visitors. In addition, it is recognised that local businesses and event organisers will wish to make full use of the Grand Depart to advertise their premises or event. Many of the land uses and advertisements will be classed as development requiring planning permission. In this regard, the Authority has not declared a ‘planning amnesty’, but nevertheless is adopting a flexible and positive approach to the event when considering planning and enforcement issues.

5.9 The next meeting of the Sedbergh & Kirkby Lonsdale Neighbourhood Forum will be held at 7pm on Wednesday 05 March 2014 at Barbon Village Hall.

5.10 A letter had been received from Kate Cairns, Chair of Governors to Dent C of E Primary School, concerning the Memorial Hall’s refurbishment project. The letter had been circulated to all members for information and consideration.

5.11 Healthwatch Cumbria South Lakeland District will hold a meeting at County Offices, Busher Walk, Kendal, on Tuesday 11 February 2014. This is an independent organisation set up to champion views of patients and social care users in Cumbria with the goal of making services better and improving health and wellbeing.  

5.12 A police report for Dentdale had been received from PCSO Mandy Coleman, including:-

i) The theft of coping stones to the value of £400 on 16 December 2013.

ii) On 17 December 2013 theft of a VW Transporter Van which had been parked in Dent.

iii) Theft of a red Honda 350 quad bike on 23 December 2013.

iv) A Landrover had been broken into at Laning on 22 December 2013 with goods to the value of £1,100 stolen. Attempts to steal the vehicle had failed.



Public Forum:

6.1 The Council was asked if it had taken a position on the delivery of superfast broadband in Dentdale. In response, it was reported that the Council was awaiting the result of Connecting Cumbria’s evaluation report concerning the delivery of broadband in Garsdale and Dentdale, in order that it could then be in possession of all necessary information and evidence to make an informed decision on its position.

6.2 It was requested that a copy of the Dentdale and Garsdale Parish Councils questions & concerns about the delivery of broadband be forwarded to Fibre GarDen. In response, it was reported that the purpose of collating the questions & concerns to the Connecting Cumbria Project Team was to help the Parish Councils in the decision making process and ensure that Connecting Cumbria consider the issues in their evaluation. It was agreed that Fibre GarDen should be sent a copy of the questions & concerns when the paper has been prepared.  



Chair and Member Announcements:

7.1 Councillor Chris Evans reported that the BritishTelecom overhead wires in Gawthrop were still causing difficulty for large hay and straw delivery vehicles due to their lack of height. It was resolved that the Clerk would once again report the matter to British Telecom.

7.2 Councillor Jenny Pilgrim reported that the Sedbergh & District Information Centre is seeking volunteers to help at the Centre. If anyone in the Parish would like to assist they should contact Andi Chappel on 015396 20504. The volunteer time of any Dent resident would be very much appreciated.

7.3 Councillor Jenny Pilgrim further reported that the damage to the bridges at St John’s and Stonehouse had still not been repaired. St John’s bridge remains a concern to the safety of the public. It was resolved that the Clerk would again report both issues to Cumbria Highways requesting projected dates when the work at both sites will be undertaken. 



Playing Field:

The minutes of the Playing Field meetings held on Thursday 12 December 2013 and Thursday 09 January 2014 were received.



Local Area Partnership (LAP):

9.1 The notes of the meeting of Monday 20 January 2014 were received.

9.2 Details were given of the proposed Lengthsman’s Scheme for the Sedbergh and Kirkby Lonsdale LAP area. A total of £6,800 has been made available by the LAP (£4,800) together with a contribution from Nick Cotton’s County Councillor budget (£2,000) to set up a Lengthsman’s Scheme in the Sedbergh & Kirkby Lonsdale area.  In the interest of simplicity and fairness it was decided that each of the ten parishes in the LAP area would receive an equal share of the available funds. Therefore, £680 will be made available to Dent Parish Council to spend on minor highways schemes.

9.3 Information was received of a proposed gritting scheme on the U5474 road section being the back road from Dent to Cowgill. This section is not classified by Cumbria Highways as a priority 1 or 2 road therefore it is not routinely gritted in conditions of ice and/or snow. A local resident had offered his services and vehicle to grit the road in times of inclement weather. Cumbria Highways had already agreed, in principle, to supply complimentary grit for this scheme subject to a suitable agreement being in place. It was resolved that the £680 available to Dent Parish Council from the LAP Lengthsman’s Scheme should be awarded to the local gritting initiative subject to satisfactory agreement with Cumbria Highways.  



Meetings Schedule 2014:

10.1 Information was received that Parish elections this year will take place on Thursday 22 May 2014.

10.2 In view of South Lakeland District Council’s electoral arrangements members reviewed the date of the Annual Parish Council Meeting which had been originally scheduled for Monday 12 May 2014.

10.3 It was resolved that the Annual Parish Council Meeting should take place on Monday 02 June 2014 to accommodate the election arrangements. 



Dentdale Run:

11.1 A request was received from the Secretary of the Dentdale Run Committee for free parking at Dentdale Car Park for those involved with the event on Saturday 08 March 2014.

11.2 It was resolved that those involved with the Dentdale Run would be granted provision of free car parking on Saturday 08 March 2014.



Litter Picking AGM:

12.1 The minutes of the annual general meeting of the Litter-Picking Committee of Monday 13 January 2014 were received.

12.2 A proposal was received for constitutional change concerning the Litter Picking Sub-Committee to avoid the bureaucracy of unnecessary meetings. The proposal involved the Litter Picking Secretary being re-defined as the Co-ordinator who would report directly to the Parish Council therefore removing the need for a sub-committee.

12.3 It was resolved that the Clerk would research the legal implications of  constitutional change in order that the Litter Picking Group can remain aligned to the Parish Council together with any change being compatible with the Parish Council’s Insurer.



Land at Beech Hill:

13.1 Documentation from South Lakeland District Council (SLDC) was received in respect of the transfer of the flower bed and seating area at Beech Hill, Dent, to the Parish Council.



13.2 The transfer would also include a previously agreed arrangement with a local contractor for SLDC to finance repairs to the paving and to the stone slate capping of the planter walls. This work would be to the reasonable satisfaction of the Parish Council and take place immediately upon exchange of contracts but prior to completion of the transfer. 

13.3 It was resolved that the land should be transferred from South Lakeland District Council to Dent Parish Council.



Protected Green Spaces:

14.1 A communication from the Yorkshire Dales National Park Authority (YDNPA) was received requesting the Parish Council to identify appropriate Green Spaces for protection within the Parish for inclusion in the YDNP Local Plan 2015-2030.  

14.2 It was resolved that The Green and Dentdale Car Park should be recorded as Protected Green Spaces. In principle, the Playing Field should not be submitted as a Protected Green Space subject to consultation with the Playing Field Committee.



Grass Cutting Contract 2014:

15.1 It was reported that the grass cutting & maintenance contract for the Playing Field and Car Park sites was due for renewal.

15.2 It was resolved to commence the tendering process with a view to securing a three year contract with the preferred supplier.




16.1 Finance Monitoring:

A report and statement of the Council’s financial position detailing income and expenditure from 01 April 2013 to 31 January 2014 was received and accepted.

17.1 Applications:

F106300 – Congregational Manse – notification of proposed works received by YDNP for 25% reduction of a cherry tree. The YDNP has raised no objections.

S/01/256 – Holme Hill, Cowgill. Application for garden room and implements store. GRANTED with conditions.
